This article continues the themes developed in a previous paper looking at reparations for past wrongs in post-colonial Australia. It narrows the focus to examine the scope of the law of tort to provide reparations suffered as a result of colonisation and dispossession, with particular emphasis on the assimilation policies whose legacy is now known emphatically, although it ought not be exclusively, as the Stolen Generations. The search for more than just words is particularly topical in light of the Australian (...) Prime Minister's formal apology in early 2008. This highly symbolic step must not lose momentum. That momentum could be both political and legal. In the latter context, we explore here the concept of alien tort, in the light of current Australian tort jurisprudence, which has thus far proved inadequate to achieve compensation for the harms suffered. Taking a comparative approach, procedural and substantive developments are to better deliver justice consistent with community values. In particular, the greater acceptance of psychological harm as actionable tortious conduct in Canada and the United States is examined. The article further examines the scope for stolen children to bring suit under the US Alien Tort Claims Act 1789. While the Australian government enjoys sovereign immunity in the courts of the United States, non-state organisations such as churches that were complicit in the forcible removals may be subject to United States jurisdiction wherever they have a presence in that country. The procedural and substantive elements of such a claim are discussed. In particular, the relevant cause of action, the issue of forum non conveniens and the statute of limitations will be analysed to map out whether a claim could be developed and successfully prosecuted. © Springer Science + Business Media B.V. 2009. But becoming or process is alone fully concrete or inclusive, since if A is without becoming, and B becomes, then the togetherness of AB also becomes. A new constituent means a new totality. In this sense, becoming is the ultimate principle.

This study of the political philosophy of William Ernest Hocking be gan as a doctoral dissertation at Tulane University. Hocking (1873- 1966) was for many years Alford Professor of Natural Religion, Moral Philosophy, and Civil Polity at Harvard University. Although he is relatively well-known among American philosophers, particularly by students of metaphysics and the philosophy of religion, very little atten tion has been given to his political philosophy. Some general studies of his thought summarize his political writings in (...) a very cursory fashion, but they do not discuss his contributions in detail or relate them to significant issues in political philosophy. Most important general works on modern political philosophy or American political thought do not even mention Hocking; a few note his name in passing. Because he is almost completely unknown in the social sciences, the original purpose of this study was to explore, systematize, and present his extensive writings in political philosophy. It then became apparent that his entire political philosophy is oriented around the concepts of liberty and community. When his thought is analyzed in terms of these themes, its unity and coherence are more obvious. Moreover, his writings become more significant when they are related to liberty and community, for these are focal concepts for important problems in modern political philosophy. This study of Hocking's political philosophy will, it is hoped, help us to see how liberty and community can be more understandable, attainable, and compatible with one another. (shrink)

Kuklick traces the history of philosophic thought in the United States "as typified and dominated by Harvard" from 1860 to 1930. He provides an analysis both of the thought of this period and of the development of Harvard University and its philosophy department. These two types of analyses are interwoven throughout the book, for Kuklick finds that the second type provides an important key to the interpretation that unfolds within the first type. Among the philosophers included are Francis Bowen, Chauncey (...) Wright, John Fiske, F. E. Abbot, C. S. Peirce, William James, Josiah Royce, Hugo Munsterberg, George Palmer, George Santayana, Ralph B. Perry, E. B. Holt, Ernest Hocking, Alfred N. Whitehead, and C. I. Lewis. Royce and James receive the most lengthy examination, and while there is a surprisingly unappreciative discussion of Whitehead’s position, it is followed by an unusually enthusiastic analysis of the philosophy of C. I. Lewis, whom Kuklick considers to be, "with the exception of Peirce... the most capable philosopher in the school we have studied." Though such a counterbalance to the more common tendency to slight the enduring achievements of Lewis’s philosophical insights is refreshing, even his most avid supporters might well hesitate to affirm such a view. Kuklick’s attitude toward Lewis, as well as his focus of attention on James and Royce, may be guided by a dominant theme of the book in general. One of the major philosophic threads which Kuklick uses to weave a unifying bond among many of the philosophers of this period is idealism, while the realistic strains of the philosophers involved are at best slighted, at worst distorted. James as well, of course, as Royce, is interpreted within the framework of idealism. Lewis, as heir to the debate between neo-realism and idealism as carried on by Perry and Royce, is seen by Kuklick as unsuccessfully attempting to repudiate the idealism bequeathed to him by Royce, thus representing the ultimate triumph of idealism over realism. In this paper, I consider a variety of objections against the covering-law model of scientific explanation, show that Aristotle was already aware of them and had solutions for them, and argue that these solutions are correct. These solutions involve the notions of nonHumean causality and of essential properties. There are a great many familiar objections, both methodological and epistemological, to introducing these concepts into the methodology of science, but I show that these objections are based upon misunderstandings of these concepts.

heories of embodied cognition (e.g., Perceptual Symbol Systems Theory; Barsalou, 1999, 2009) suggest that modality specific simulations underlie the representation of concepts. Supporting evidence comes from modality switch costs: participants are slower to verify a property in one modality (e.g., auditory, BLENDER-loud) after verifying a property in a different modality (e.g., gustatory, CRANBERRIES-tart) compared to the same modality (e.g., LEAVES-rustling, Pecher et al., 2003). Similarly, modality switching costs lead to a modulation of the N400 effect in event-related potentials (ERPs; Collins (...) et al., 2011; Hald et al., 2011). This effect of modality switching has also been shown to interact with the veracity of the sentence (Hald et al., 2011). The current ERP study further explores the role of modality match/mismatch on the processing of veracity as well as negation (sentences containing “not”). Our results indicate a modulation in the ERP based on modality and veracity, plus an interaction. The evidence supports the idea that modality specific simula- tions occur during language processing, and furthermore suggest that these simulations alter the processing of negation. (shrink)

The techniques of natural duality theory are applied to certain finitely generated varieties of Heyting algebras to obtain optimal dualities for these varieties, and thereby to address algebraic questions about them. In particular, a complete characterisation is given of the endodualisable finite subdirectly irreducible Heyting algebras. The procedures involved rely heavily on Priestley duality for Heyting algebras.

The correctness of application of orientalist discourse of E. Said to the colonial policy of the Russian Empire is analyzed in the article on the example of P. I. Rychkov research. By studying integration of Bashkirs in the structure of the Russian state, the author came to the conclusion that Russia’s policy in the East was based on the experience of the management of non-Russian peoples, which was developed in the 16-17th centuries. The establishment of ‘cultural distance‘ is typical only (...) for a small group of educated administrators of past-Petrine era. Most of the officials of the region, as in the preceding period, and during the time of Rychkov and Tatishchev preferred to rely on traditional methods of Bashkir management, which was developed in the period of their voluntary accession. Managerial stereotypes of 16-17th centuries, had significant influence on policy towards South-Eastern peoples of Russia even in the 19th century. The Russian administration inherent in the desire to integrate the non-Russian peoples in the General class structure of the state on the basis of analogies or correspondences, the objective of which was social and cultural rapprochement of the two societies. Psychoactive drugs are being prescribed to millions of Americans at an increasing rate. In many cases these drugs are necessary in order to overcome debilitating emotional problems. Yet in other instances, these drugs are used to supplant, not supplement, interpersonal therapy. The process of overcoming emotional obstacles by introspection and the attainment of self knowledge is gradually being eroded via the gratuitous use of psychoactive medication in order to rapidly attain a release from the common problems that life inevitably presents (...) us with. In this paper, I argue that Kant’s formula of humanity, which maintains that persons ought never to treat others or themselves soley as a means to an end, proscribes this. Moreover, Kant argues that we have an imperfect duty of self development, and I argue that we fail to adhere to such a duty whenever we seek to evade the process of introspection and self knowledge in favour of the expedient results that drugs may provide us with as we attempt to overcome the emotional hurdles in our lives. Both syntactic and semantic solutions are given for the entailment problem of duality theory. The test algebra theorem provides both a syntactic solution to the entailment problem in terms of primitive positive formulae and a new derivation of the corresponding result in clone theory, viz. the syntactic description of $\operatorname{Inv(Pol}(R))$ for a given set R of finitary relations on a finite set. The semantic solution to the entailment problem follows from the syntactic one, or can be given in the form (...) of an algorithm. It shows, in the special case of a purely relational type, that duality-theoretic entailment is describable in terms of five constructs, namely trivial relations, intersection, repetition removal, product, and retractive projection. All except the last are concrete, in the sense that they are described by a quantifier-free formula. It is proved that if the finite algebra $\underline{M}$ generates a congruence-distributive variety and all subalgebras of $\underline{M}$ are subdirectly irreducible, then concrete constructs suffice to describe entailment. The concept of entailment appropriate to strong dualities is also introduced, and described in terms of coordinate projections, restriction of domains, and composition of partial functions. (shrink)

Georgians' acquaintance with Islam was with the first Arab raids. From the first Muslim Arab domination, Georgians started to become Muslims with cultural interaction. Islam spread especially in Eastern Georgia during the time of Muslim Arabs, Seljuks and Mongols. The spread of Islam in Western Georgia started with the Ottomans. The Ottoman Empire's contact with Georgia begins with the conquest of Trabzon by Fatih Sultan Mehmed. When the Ottomans contacted the region, the geography of Georgia was divided into small kingdoms. (...) With the conquest of Trabzon, the Georgian border was reached and in 1479, Acaristan, Borcka and Maçahel surroundings joined the Ottoman lands. On the one hand, Sukhumi was captured from the north. Then, continuing to advance in the region, Yavuz Sultan Selim paid tribute to the Kingdom of Güryel and Imeret (Açıkbaş) in 1508 during his governorship of Trabzon. Thus, the Ottoman borders had reached beyond the Black Sea coast into Western Georgia. As a result of the increasing relations around Adjaria, which came under Ottoman rule, Islamization began to spread rapidly among the people. Contrary to what is claimed, the spread of Islam in the region did not spread from the ruling strata to the lower, but from the popular strata to the ruling strata. This process was surprisingly fast. In the process of Islamization, many mosques, masjids and schools were built in Adjara, especially with the help of the people. The foundations operating in the region and the mosques and masjids serving under them show that, contrary to the claims of Russian and Georgian historians, Islamization took place rapidly at the beginning of the 17th century in Adjara. In this process, many mosques, masjids and schools were built in the region. In this research, based on the numerous Hurufat records belonging to Adjara, Batumi, Gönye, Çürüksu and Maçahel, the Islamization process will be evaluated by making a social reading with the data obtained from the religious structures established in the rural settlements of the Adjara geography and their officials.
